Nudity Laws Unveiled

Is it illegal to be nude in England? Apparently not…Or, kind of, or in fact yes. Maybe.

To the best of my knowledge, although I had done no research on the topic, I thought that public nudity was illegal in England.  People would appear to have been put in prison for it, and so there would appear to have been some evidence on the face of it that it was against the law.  In the same way that I’ve never read a law against theft, but I am led to believe that there is one. 

Perhaps though, I should start reading law, because I recent news story has led me to question my understanding of the law in this case where I thought the law was, well, naked.  As part of the people art of Trafalgar square , a man stood naked on the plinth, to express some artistic sentiment.  Complains were made, and a court case brought.  But, as it turns out, it is not in fact illegal to be naked in England or Wales.  In fact, the only way in which this would be illegal is if your actions were deemed to be organised to course offence.  So, if I wonder about naked because I enjoy the pleasurable breeze on my privates it is in fact not illegal, unless someone can prove that I had intended to cause offense.  Within reason this is clearly impossible, thus people imprisoned  for public nudity must be placed they by some for of unreason. 

It seems like a fair case could be made that the law needs reform to have less of a strange subjective element in it.  However, I suspect that Politian’s have nightmares about the mockery they’d receive for bringing the topic up in parliament. 

I wonder if, that in these nightmares they are naked?
